SSir Online School
Individual Student Enrolment Agreement
2027 | Version 04
The terms governing an Individual Student enrolment with SSir Online School.

This Agreement sets out the proposed terms governing the enrolment of the Student in the SSir course identified in the Individual Student Application. It is intended to become binding between SSir Online School CC, trading as SSir, and the Parent/Guardian identified in the Application once SSir has accepted the application. Where another person or organisation is responsible for the account, that party becomes financially liable only once it has separately accepted that responsibility.

1
Definitions and Purpose

“SSir” means SSir Online School CC.

“Student” means the minor learner identified in the Individual Student Application.

“Parent/Guardian” means the parent or legal guardian who submits the Application and concludes this Agreement on behalf of the Student.

“School” means the school or other educational institution, where applicable, through which the Student studies other subjects and/or is entered for the National Senior Certificate examination.

“Course” means the SSir course for which the Student is accepted.

“Contract Period” means the period stated in SSir’s enrolment confirmation or invoice.

“PRA” means a Person Responsible for the Account where that person or organisation is not the Parent/Guardian.

SSir provides specialist online teaching and related educational services for the Course. SSir is not the Student’s examination body and does not itself enter the Student for the final Grade 12 National Senior Certificate examination.

2
Enrolment and Contract Period

Submission of an Individual Student Application constitutes an application for enrolment and the Parent/Guardian’s acceptance of the proposed terms of this Agreement. It does not by itself require SSir to accept the Student. SSir may consider the application and confirm the Course, grade, examining body, Contract Period, fees and any special arrangements before accepting the enrolment.

Once SSir accepts the application and confirms the enrolment, this Agreement, the submitted Application, SSir’s enrolment confirmation or invoice, and any expressly incorporated document together record the binding agreement for that enrolment. The Contract Period begins on the date or on the basis stated in SSir’s enrolment confirmation or invoice.

For a normal full-year enrolment, SSir’s programme is designed to cover the applicable curriculum and assessment programme for the Course. For a late or shortened enrolment, SSir’s responsibility begins with the agreed Contract Period. SSir will make reasonable professional efforts to integrate the Student and identify significant inherited deficiencies, but does not guarantee that missed teaching, assessments, PAT/SBA work or other deficiencies arising before enrolment can be remedied.

3
Services Provided by SSir

During the Contract Period, SSir will provide and/or make available the teaching programme, learning resources, assessment opportunities, marking, feedback and academic records appropriate to the Course and grade. Where applicable, SSir will also provide PAT guidance, staged assessment and portfolio-related documentation.

SSir may determine and change teaching methods, resource formats, lesson sequences, assessment scheduling and day-to-day delivery in its professional judgment, provided that the overall educational service remains appropriate to the Course.

SSir staff may communicate directly with the Student for legitimate educational and administrative purposes, including through SSir’s learning management system, email and online teaching platforms.

4
Parent/Guardian and Student Responsibilities

The Parent/Guardian is responsible for supporting the Student’s participation in the Course and for ensuring, so far as reasonably possible, that the Student has suitable computer equipment, internet access, prescribed textbooks, required software and an appropriate environment for online study.

The Student is expected to participate reasonably in the Course, complete required work, observe published deadlines and communicate appropriately with SSir staff.

The Parent/Guardian must provide accurate information relevant to the enrolment and must inform SSir of material changes to contact details, School, examining body or other circumstances that could affect delivery of the Course.

5
School, Examination and Invigilation Arrangements

The Parent/Guardian acknowledges that SSir does not register the Student with an examining body for the final Grade 12 National Senior Certificate examination. Responsibility for the Student’s examination registration remains with the School, Parent/Guardian or other responsible examination arrangement, as applicable.

SSir does not ordinarily provide physical invigilation of formal tests and examinations. The Parent/Guardian is responsible for ensuring that suitable invigilation arrangements are made through the School or another arrangement acceptable for the relevant assessment and examining-body requirements.

Final Grade 12 practical examinations. Where the Course includes a final Grade 12 practical examination, the examination must be administered at an appropriately authorised examination centre under the relevant examining body’s requirements. The School or authorised examination centre is responsible for designating a suitably competent person, normally the School’s liaison teacher where permitted, to carry out the required on-site duties. These may include printing and correctly identifying candidates’ work, making and securely retaining backups, completing required declarations, and securely packaging and submitting examination material by the prescribed deadlines. SSir does not provide personnel physically present at the examination centre and does not assume responsibility for these on-site duties. The Parent/Guardian is responsible for confirming with the School or examination centre that the necessary arrangements are in place.

Where the School participates in the Student’s SSir programme, the Parent/Guardian authorises SSir to communicate with an appropriate school contact about legitimate academic and administrative matters concerning the Course.

6
Assessment and PAT

SSir will provide appropriately scheduled assessment opportunities for the Course and will mark assessments for which it is responsible. Missing an assessment does not automatically entitle the Student to a replacement assessment; SSir may make an alternative arrangement where appropriate and practicable.

Where a PAT applies, SSir will provide instructions, staged deadlines, assessment, feedback and permitted opportunities for resubmission in accordance with the programme. The Student remains responsible for completing and submitting the required work and evidence within the applicable timeframes.

The School and/or Parent/Guardian remains responsible for any formal submission, portfolio or examination-body process that falls outside SSir’s role. SSir cannot create compliant evidence for work that the Student has not completed or submitted.

7
Fees, Payment and Financial Responsibility

The fee confirmed by SSir is the fee for the Contract Period. Any instalment arrangement is a method of paying that contracted fee and does not convert the enrolment into separate monthly, termly or quarterly purchases.

The Parent/Guardian is responsible for the account unless SSir has accepted a separate PRA who has expressly accepted financial responsibility. Merely naming another person or organisation as payer does not by itself transfer the Parent/Guardian’s financial responsibility.

The applicable fee, initial payment and instalment dates will be stated in SSir’s enrolment confirmation or invoice. Initial course access may be made conditional on receipt of the required first payment.

If an amount becomes materially overdue and remains unresolved after reasonable attempts to obtain payment, SSir may suspend future course access, teaching support and/or marking while the account remains overdue, subject to applicable law. Amounts properly due remain payable despite such suspension.

8
Cancellation and Withdrawal

The Parent/Guardian may cancel or withdraw the Student in accordance with rights available under applicable law and the cancellation terms communicated for the enrolment. Where the Consumer Protection Act or other consumer law applies, nothing in this Agreement is intended to remove a statutory cancellation right.

Where cancellation is permitted subject to a reasonable cancellation charge or other lawful adjustment, SSir may take into account the timing of cancellation, services already provided, costs incurred, the nature of the Contract Period and other factors permitted by law.

Any additional discretionary credit or financial arrangement granted by SSir in a particular case does not create an entitlement or precedent for another enrolment.

9
Personal Information and Privacy

SSir may collect, store and process personal information about the Parent/Guardian and Student to administer the enrolment, provide the Course, communicate with the parties, maintain academic records, manage assessments and accounts, and meet legitimate educational, contractual and legal requirements.

Because the Student is a minor, the Parent/Guardian provides the permissions and information lawfully required for SSir to process the Student’s personal information for the purposes of the enrolment. SSir’s Privacy Notice or POPIA Policy provides further information about its processing practices.

Where reasonably necessary for the Student’s education, assessment or examination arrangements, SSir may share relevant information with the School, examining body or service providers used to deliver the programme, subject to applicable privacy law.

Learner work, assessment records, assignments, examination submissions, forum contributions and learning activity may be stored electronically on Moodle and related educational systems.

10
Intellectual Property and Student Work

SSir retains its rights in its teaching videos, Moodle course content, assessments, question banks, instructional resources and other materials created or licensed for the programme. The Parent/Guardian and Student may use those resources during the Contract Period for the Student’s educational participation in the contracted Course. This permission does not extend to using SSir resources to provide teaching or course materials after the Contract Period has ended. No ownership of SSir’s underlying course content is transferred.

The Student retains rights in the Student’s original work. SSir may receive, store, process and assess that work as reasonably necessary to provide the Course and maintain appropriate academic records.

11
Ending of Services

This Agreement ends at the end of the Contract Period unless ended earlier in accordance with this Agreement or applicable law. Expiry ends ongoing teaching, support and new academic services, but SSir will complete reasonable outstanding obligations arising from the Contract Period, such as marking properly submitted work or providing legitimately outstanding academic records.

If SSir is genuinely unable to continue providing the Course for reasons not caused by the Parent/Guardian or Student, SSir will act reasonably to minimise disruption and will make an appropriate academic handover and financial adjustment for services not provided.

12
Electronic Acceptance and Records

This Agreement is intended to be accepted electronically as part of the Individual Student Application process. The Parent/Guardian will be required to identify themselves, confirm that they have had an opportunity to read and retain this Agreement, and expressly indicate acceptance before submitting the Application.

SSir may retain the submitted Application, the version of this Agreement accepted, the date and time of submission, the identifying details supplied by the Parent/Guardian and related enrolment communications as evidence of the transaction.

The Student’s participation in the Course is not relied upon as the Parent/Guardian’s signature or acceptance of this Agreement.

13
Communication and General Terms

Routine communications may take place through the email addresses, telephone numbers and electronic systems supplied or ordinarily used for the enrolment. The Parent/Guardian must keep relevant contact details reasonably current.

No failure by SSir to enforce a provision immediately, and no discretionary accommodation granted in a particular case, constitutes a permanent waiver of that provision.

If a provision of this Agreement is invalid or unenforceable, the remaining provisions continue to operate to the extent permitted by law.

This Agreement is governed by the laws of the Republic of South Africa. Nothing in it excludes or limits a right or remedy that cannot lawfully be excluded or limited.
